DayBrief: Terms of Service

These terms (“Terms”) govern your use of DayBrief (“the App”), a monday.com marketplace application operated by Kainabinoids GmbH (“we”, “us”), Carabelligasse 5/Haus 56, 1210 Wien, Österreich (FN 607246i, Handelsgericht Wien; UID ATU80796845). By installing or using the App, the organization on whose monday.com account it is installed (“you”) accepts these Terms.

1. The service

DayBrief sends each enrolled person on your monday.com account a scheduled email digest of the items assigned to them that are overdue, due today, or due this week, drawn from the boards they can see and grouped by board. An admin installs the App, enrolls recipients, and sets the schedule (timezone, send hour, weekdays). A master switch turns sending on or off.

2. monday.com marketplace

The App is distributed through the monday.com marketplace and runs on monday.com’s infrastructure. Your use of monday.com remains governed by your agreement with monday.com. Installation, billing, and payment are handled by monday.com; we do not process your payment data. If the App is offered with paid tiers, monday.com bills you and remits applicable tax.

3. Eligibility and accounts

The App is intended for use by organizations on a monday.com account. The person who installs it must be authorized to do so on your behalf and to enroll the recipients they add. You are responsible for the actions taken under your account.

4. Acceptable use

You agree not to:

• use the App to send unsolicited email to people who are not members of, or collaborators on, your monday.com account;
• attempt to access data of monday.com accounts other than your own;
• interfere with, overload, reverse-engineer, or circumvent the App’s security or rate limits; or
• use the App in violation of applicable law.

We may suspend or terminate access if the App is used in breach of these Terms.

5. Data and privacy

We process personal data as a processor on your documented instructions under Article 28 GDPR. How we handle data is described in our Privacy Policy; the contractual terms are set out in our Data Processing Agreement, which is incorporated into these Terms and which you accept by installing the App. The sub-processors we use are listed at Sub-processors. DayBrief does not retain the content of your tasks.

6. Availability

We aim to deliver digests reliably on the schedule you set, but the App is provided on an “as available” basis. Delivery depends on monday.com, on email infrastructure, and on the data in your account. We do not guarantee uninterrupted or error-free operation and may perform maintenance, updates, or changes to the App.

7. Intellectual property

The App, its name, logo, and underlying software are owned by Kainabinoids GmbH. These Terms grant you a limited, non-exclusive, non-transferable right to use the App while it is installed. Your data remains yours.

8. Disclaimer

To the extent permitted by law, the App is provided without warranties of any kind, whether express or implied, including fitness for a particular purpose. DayBrief is a convenience that surfaces due dates by email; it does not replace your own review of your work in monday.com, and we are not responsible for tasks missed because a digest was delayed, undelivered, or filtered by an email provider.

9. Limitation of liability

To the extent permitted by law, we are not liable for indirect, incidental, or consequential damages, or for lost profits or data, arising from your use of the App. Nothing in these Terms limits liability that cannot be limited under Austrian law, including for intent or gross negligence or for harm to life, body, or health.

10. Term and termination

These Terms apply for as long as the App is installed on your monday.com account. You may terminate at any time by uninstalling the App. On uninstall, all processing and sending stop immediately and the OAuth access credentials are deleted at that point. Remaining stored configuration and delivery metadata are deleted upon reconnection or on request, as described in the Privacy Policy.

11. Changes to these Terms

We may update these Terms when the App or applicable law changes. We will update the date above and, for material changes, notify the App’s admin. Continued use after a change constitutes acceptance.

12. Governing law and jurisdiction

These Terms are governed by Austrian law, excluding its conflict-of-law rules and the UN Convention on Contracts for the International Sale of Goods. Mandatory consumer protections of your place of residence remain unaffected. The courts competent for 1210 Wien, Österreich have jurisdiction, to the extent permitted by law.
